Disparate Impact Makes America Dumber And More Dangerous

In our last post ("We Shouldn't Have To Live Like This") we shared Kevin Dolan's thoughts about how an aspect of civil rights law, Disparate Impact, made America's cities violent and its suburbs sterile. 

As Kevin wrote there, 

“Disparate impact” assumes that human beings are precisely alike across all protected classes, and therefore any statistically significant difference in aggregate outcomes can be regarded as prima facie evidence of illegal discrimination [...]

Even standards that the vast majority of protected individuals would meet, like “being able to touch your toes” or “knowing how to read” or “not stealing everything that isn’t nailed down”.

It doesn’t matter that most minority applicants to the Maryland State Police could touch their toes. The point is that fewer minority applicants could touch their toes — which means that that standard is racist and must be abolished.

This means that, in any space controlled by an institution with more than 15 employees, it is illegal to hold protected individuals to any standard of competence or behavior.

Disparate Impact Strikes Again 

The DOJ's case against the Maryland State Police that Kevin mentioned above wasn't anomalous--it has been doing this all over the country. The latest example was the Durham, North Carolina Fire Department, where the DOJ determined that it was racist to require firefighters do be able to do the basic arithmetic required of the job. 

A Death Sentence For The American Empire

As "Labrador Skeptic" put it on X, Disparate Impact is ultimately a death sentence for America as a super power:

Disparate Impact is the death sentence for the Global American Empire. Unless it completely repudiated there will be no manufacturing renaissance, military defeat is inevitable, and the Tech wars will be lost. A long descent becomes inevitable, as the power increasingly fails even as other key aspects of our infrastructure continue to fail with a frequency that builds every year.

A POS judicial system that invents the need for every level of governmental and private organization to hire stupid people on a racial & gender basis guarantees the ongoing failure of the systems that our lives depend on.

We cannot compete with China or Russia when disparate impact handcuffs every level of public & private efforts. We lose economically, we lose militarily, we will not have the ability to support our standards of living, and when any efforts to regain our ability to support ourselves are handicapped out of the box by the requirement to hire people too stupid to pass a written test - there will never be a recovery.

Crucially, note that high levels of immigration rapidly accelerate this process. We are close to the point where it will be legal requirement for the management of all organizations to be POC, regardless of qualifications.

We will be in the equivalent of a plane pointing down towards the ground while accelerating at that point. 

Elections have consequences. May those who vote Dem live without power, clean water or reliable food. You're bringing it on yourselves, that's fine and even a form of justice. Not for the rest of us, however.

Why Not Make November's Election A Referendum On This? 

As Labrador Skeptic wrote there, elections have consequences. So why not make November's election a referendum on this? 

Trump should run against Disparate Impact.
